PARENTAL WAIVER AND RELEASE OF LIABILITY:

This document is deemed read, understood, and accepted by the parent/legal guardian upon payment and enrollment of the child(ren) into Play Town by Play O Amusement Private Limited. By enrolling and making payment, the undersigned parent/legal guardian acknowledges and agrees to the following terms and conditions, and understands that participation is voluntary and at their own risk.

1. Confirmation of Responsibility

I hereby confirm that I am the lawful parent/legal guardian of the minor child(ren) (“Participant(s)”) enrolled at Play Town by Play O Amusement Private Limited ("Play Town"). I understand that I am fully responsible for the safety, wellbeing, and supervision of the Participant(s) while they are on the premises.

2. Understanding the Nature of Activities

I acknowledge that the Participant(s) may participate in a range of physical and recreational activities at Play Town, which may include but not limited to: use of toys and play equipment, climbing structures, slides, running areas, soft play,Video Games, Small electrical rides and other amusement-based activities. These activities may involve movement, physical exertion, and interaction with other children inside the premises.

3. Assumption of Risk

I acknowledge that participation in such activities carries inherent risks, including but not limited to: :

• Minor or serious injuries (e.g., bruises, cuts, fractures).
• Illness or infection.
• Emotional distress or allergic reactions.
• Allergic reactions.
• Loss or theft of personal belongings.
• Personal injury, including death.
• While Play Town maintains high safety standards and hygiene protocols, I understand that while Play Town upholds strict safety and hygiene protocols, all risk cannot be eliminated due to the nature of children’s play.

4. Release of Liability

To the maximum extent permitted under Indian law, I hereby waive, release, and discharge Play Town by Play O Amusement Private Limited, its directors, employees, agents, and representatives from any and all liabilities, claims, demands, or causes of action for injuries, losses, or damages—whether physical, emotional, or financial—arising from or connected to my child(ren)’s participation in Play Town’s activities. This waiver includes, but is not limited to:

• Accidental injury.
• Illness, including infectious diseases (e.g., COVID-19).
• Damage or loss of personal belongings.
• Any negligent acts or omissions by Play Town, except for wilful misconduct or gross negligence.

5. Health and Safety Representations

I represent and confirm that:

• The Participant(s) are in good physical and mental health and have no known condition that would prevent safe participation in activities.
• I have explained the nature of the play area and potential risks to the Participant(s).
• The Participant(s) are not showing symptoms of contagious illness, fever, rash, or other health concerns at the time of entry.
• I will remove the Participant(s) from the play area if they feel unwell, experience discomfort, or show signs of illness or distress.

6. Conduct and Rules

I agree to comply with all rules, guidelines, and instructions provided by Play Town staff. I understand that failure to follow rules, or any form of misbehavior, may result in the removal of the Participant(s) from the premises without refund.

7. Indemnity Clause

I agree to indemnify and hold harmless Play Town by Play O Amusement Private Limited and its representatives from any claims, damages, or losses arising due to my or the Participant(s)’ conduct, breach of rules, or misrepresentation.

8. Dispute Resolution and Jurisdiction

In case of any dispute arising under this waiver, I agree to first attempt to resolve the matter amicably. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts of [City, State of the play area], governed under Indian laws.

9. Agreement Binding Through Enrollment

By making payment and enrolling the Participant(s) at Play Town, I confirm that I have read, understood, and voluntarily agreed to this Waiver and Release. I understand that this document is legally binding, and my acceptance is deemed confirmed by payment and use of services.

Note: This waiver forms an integral part of the invoice. Proceeding with the booking and payment constitutes full and unconditional acceptance of all terms stated herein.

I, the parent/legal guardian of the minor child(ren)/Participant(s), hereby give my consent and confirm that I have read, understood, and agreed to the Play Town by Play O Amusement Private Limited rules and waiver at the time of Invoicing / enrollment.
